Prostitution

Under the Texas Penal Code this offense is committed when a person knowingly:

  • Offers to engage, agrees to engage, or engages in sexual contact for a fee (either receiving a fee or paying a fee) 
  • Solicits another in a public place to engage in sexual conduct with them for money (whether the individual solicits a person to hire or offers to hire the person solicited)

This is a Class B Misdemeanor.

It is a Class A Misdemeanor if the defendant has been previously convicted one (1) or two (2)  times for prostitution. 

It is a State Jail Felony if the defendant has been previously convicted three (3) or more times for prostitution.

It is a Second Degree Felony if the person solicited is younger than eighteen (18) years of age regardless of whether the defendant knew the age of the person solicited at the time the offense was committed.
